On June 10, 2011, staff met with BlackRock representatives to discuss public reporting, block trades and related issues that BlackRock had raised in various public comment letters.  Specifically, BlackRock explained how allocation to their clients occurs and various issues related to allocation.

The topic of the meeting was non-spot month federal class limits and exchange-set limits and accountability levels for cash-settled contracts.

The bank supports the exclusion of ETF manager and intermediary futures positions from position limits.

In a conference call with CFTC staff, MSUSA employees and consultants raised questions relating to the definition of swap dealer and the registration and regulation of swap dealers; in particular, the applicable requirements for foreign entities and their U.S.-based affiliates transacting with U.S. counterparties. CFTC staff advised that the CFTC's proposed registration requirement applies to any entity that is a swap dealer, as that term is defined in the Dodd-Frank Act and in any final rulemaking adopted by the Commission to further define the term.

Discussion of extra-territoriality matters.

Participants discussed the swap definition in connection with Just Energy's business supplying power and natural gas to customers. Participants also discussed Just Energy's collateral arrangements.
