System of Records Notices

The Privacy Act requires Federal agencies to publish a system of records notice (SORN) in the Federal Register upon the establishment and/or modification of a system of records describing the existence and character of the system.  A SORN identifies the system of records, the purpose(s) of the system, the authority for maintaining the records, the categories of records maintained in the system, the categories of individuals about whom records are maintained, the routine uses to which the records are subject, as well as additional details about the safeguards in place to protect the records. A system of records is a group of records under the control of a Federal agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual (such as name, employee number, social security number, etc.).

Exemptions

The Privacy Act includes provisions that allow Federal agencies to claim exemptions from certain requirements in the statute.  A SORN is marked as “exempted” if the CFTC has claimed exemptions for the particular system of records.

Disclosures

Pursuant to the Privacy Act at 5 U.S.C. § 552a(e)(4)(d), Federal agencies are required to publish in the Federal Register each routine use of the records contained in the system, including the categories of users and purpose of such use.

This system contains all pleadings, motions, applications, stipulations, affidavits, transcripts, and documents that are part of an administrative or reparations proceeding, in addition to related correspondence and indices.

This system contains records compiled for law enforcement purposes and may include all or any part of the records developed during an investigation of violations or potential violations of the Commodity Exchange Act.

This system includes records related to CFTC debt collection efforts, which generally includes records of collection made; notice to the debtor requesting payment; credit reports; reports of asset searches; copies of income tax returns; financial statements reflecting the net worth of the debtor; the basis on which the debt was terminated or compromised; and referrals to other government agencies for further collection actions.

This system accounts for information maintained about individuals that is included in Office of the Inspector General (OIG) audit files.  The purpose of this system is to maintain a management information system for CFTC OIG audit projects (such as financial statement audits, performance audits, and other audit projects relating to the programs and operations of the CFTC); and OIG personnel (such as staff training records and conflict of interest certifications necessary for peer review purposes); and to assist in the accurate and timely conduct of audits and audit projects.

The system collects and maintains information on CFTC advisory committee and subcommittee applicants and members, and those who make recommendations for committee or subcommittee memberships, or otherwise interact with the CFTC regarding its advisory committees and subcommittees. The records are used for the administration of the CFTC’s advisory committees and subcommittees. The records are also used to document and manage committee and subcommittee memberships, to receive public input regarding the work of the advisory committees and subcommittees, and to complete the annual mandatory FACA report to the General Services Administration (GSA).

The purpose of this system is to receive, track, process, and report the processing of requests for reasonable accommodations and for personal assistance services.  It maintains records from qualified employees and applicants with disabilities, as defined by the Rehabilitation Act of 1973 and the Americans with Disabilities Act, as amended by the Americans with Disabilities Amendment Act of 2008, and records from employees with targeted disabilities who request or receive personal assistance services. It also maintains records received from employees who request or receive accommodations under Title VII of the Civil Rights Act of 1964.
