On September 27, 1999, respondents Frank Amodeo and Kenneth L. Carter moved to supplement their appeal briefs in the above-captioned matter in order to further brief the issue of expert testimony in light of the recent initial decision in In re Gorski, CFTC Docket No. 93-5 (ALJ Aug. 23, 1999). The Division of Enforcement opposes respondents' motion.

The motion for leave to file a supplemental brief is DENIED. The Commission's Rules of Practice provide that parties appealing an initial decision or other final disposition by an ALJ must file an appeal brief and may file an answer brief; no further briefs are permitted. 17 C.F.R. � 10.102(b)(3). Furthermore, the decision in question is a matter of public record.
