On August 5, 1999, complainant filed a notice of appeal from an initial decision issued on July 22, 1999. Commission Rule 12.401(b) requires that an appealing party perfect its appeal by submitting an appeal brief within thirty days of the date the appeal is filed. Although the period for perfecting complainant's appeal has expired, complainant's appeal brief does not appear in the record. In these circumstances, complainant's appeal is dismissed as unperfected. Pursuant to 17 C.F.R. § 12.401(b), the initial decision shall become the Commission's final decision on the date that this order is served.
