UNITED STATES OF AMERICA
Before the
COMMODITY FUTURES TRADING COMMISSION

MARY P. KARNISH, and
EDWIN A. KARNISH,
Complainants

v.

ALBERT MICHAEL GREENHOUSE
Respondent.

CFTC Docket No. 98-R011

ORDER PURSUANT TO
DELEGATED AUTHORITY

Complainants filed a timely notice of appeal from the Judgment Officer's Initial Decision of August 28, 1998, dismissing their complaint. However, the complainants failed to perfect their appeal by filing a brief, as required by Commission Rule 12.401(b), 17 C.F.R. 12.401(b) (1998). A brief should have been filed on or before September 21, 1998. Because the complainants have failed to file their brief, this appeal is dismissed.

IT IS SO ORDERED.1
