The Division of Enforcement ("Division") has applied for interlocutory review in this proceeding. At issue are certain draft witness statements that have not been made a part of the record. The Administrative Law Judge ("ALJ") conducted an in camera review of these statements and returned them to the Division. See Order dated Dec. 8, 1997 at 3 n.9.

In furtherance of the Commission�s consideration of this matter, the Division is directed to file under seal for inspection in camera by the Commission each of the draft witness statements that the ALJ ordered the Division to produce to the respondents within one business day of the date of this order. Access to the materials filed under seal shall be limited to the Commission and its decisional employees. No service of the materials on the respondents shall be made, nor shall the respondents be allowed access to the materials.
