    Rule Numbers – New NYMEX Division Rules 9.26, 9.27 and 9.34
    The amendments remove the NYMEX Brent Crude Oil and Northwest Europe Gasoil Contracts from NYMEX Division Rules 9.26 and 9.27 for purposes of positions limits and accountability levels. The amendments correspond with similar action taken by NYMEX Europe Limited (“NEL”). Exchange Notice No. 05-345 dated August 26, 2005, announced the migration of these contracts in 2005. NEL received Financial Services Authority (“FSA”) recognition as a U.K. investment exchange on September 5, 2005. Brent Crude Oil futures and options and Northwest Europe Gasoil futures began trading in London on September 12, 2005. Additionally, the amendment to the reporting level under NYMEX Division Rule 9.34 removes the “NYMEX” contract. These amendments will be effective Tuesday, December 20, 2005.

    Effective on the open of trading on Monday, December 12, 2005, NYMEX will implement procedures to set hard limits on the number of Floor Members who may stand on a particular step in the trading ring. As proffered in the Rule, implementation will be on a ring-by-ring basis as per the direction of the Board of Directors. As of the effective date, only the Crude Oil futures ring will be governed by the new Rule. The new Rule also establishes objective criteria for use by Exchange Staff in determining who would be eligible to stand on a particular step, and specifies the disciplinary action to be taken for violators of the Rule.
